摘要
为防止或减轻沿海工程对海洋环境造成的不利影响，建设项目实施前必须依法进行环境影响评价。对于沿海工程未依法进行环境影响评价的行为，我国已在《中华人民共和国海洋环境保护法》和《中华人民共和国环境影响评价法》中规定了相应的法律责任。但在法律责任的规定和适用上还存在诸多不足。本文以相关法律规定为理论依据，分析发现存在适用不足、缺乏相应收费、民事责任缺失等问题，并对这些问题进行分析，并提出填补法律漏洞、增设新收费、增加民事责任规定等建议，旨在为我国海洋环境法律责任制度的完善贡献力量。

Abstract
To prevent or mitigate the adverse impact of coastal projects on the marine environment, environmental impact assessment must be carried out according to law before the implementation of construction projects. For acts of coastal projects that do not carry out environmental impact assessments according to law, China has stipulated corresponding legal responsibilities in the Marine Environmental Protection Law of China and the Environmental Impact Assessment Law of China. However, there are still many shortcomings in the provisions and application of legal liability. Based on relevant legal provisions as the theoretical basis, this article analyzes and finds that there are problems such as insufficient application, lack of corresponding charges, and lack of civil liability. It analyzes these problems and proposes suggestions to fill legal loopholes, add new charges, and increase civil liability provisions. This paper aims to contribute to the improvement of China's marine environmental legal liability system.
